Under the national Wage Protection System (WPS / نظام حماية الأجور) overseen by the Ministry of Human Resources and Social Development (MHRSD), all private companies operating in Saudi Arabia are required by law to disburse employee salaries through licensed Saudi banking institutions. These payroll files are monitored digitally in real time through the Mudad platform to ensure workers receive their contractual wages punctually and without arbitrary deductions.

How the Wage Protection System Operates

  • Electronic Comparison: Each month, the company submits a digital Salary Information File (SIF) through their bank. Mudad cross-checks the actual bank deposit against the authenticated wage stipulated in the employee's Qiwa contract.
  • Deduction Violations: The system automatically triggers an inspection alert if unjustified salary deductions exceed 50% of a worker's basic wage or if pay is withheld.

Expat Employee Rights Regarding Late Salaries

Saudi labor regulations outline severe compliance penalties for businesses that delay payroll:

  • 1 Month Delay: The Ministry issues official compliance warnings and inspection inquiries to the company.
  • 2 Months Consecutive Delay: The company faces a suspension of all government electronic services, except for the issuance and renewal of work permits.
  • 3 Months Delay (Critical Expat Right): If an employer fails to pay your wage for three consecutive months, the expatriate worker is legally entitled to transfer their job sponsorship to any new company on Qiwa without requiring the current employer's permission or notice period.

How to Respond to a Salary Delay Notification on Mudad

If an employer submits a justification for delayed payment, the Mudad system sends an electronic alert to the employee:

  1. Log in to Mudad.com.sa via Nafath.
  2. Review the employer's submitted justification under Wage Justifications.
  3. You have 3 business days to officially Accept or Reject the employer's explanation. If rejected, the grievance escalates automatically to MHRSD labor inspectors.
